US Judge Orders Release of Abrego Garcia from ICE Custody

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in immigration custody.

In her order, the judge noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court proceedings involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his release from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
